These Terms and Conditions govern your use of the company's website (the "Site") and your relationship with PortucaleFineWines (the "Company" or "us"). Please read carefully how they affect your rights and responsibilities under the law. If you do not agree to these Terms and Conditions, please do not use the Company's website. Use of the Company Website
The Company Website is provided for your personal use subject to these Terms and Conditions. By using the Company's website you agree to be bound by these Terms and Conditions. References to these Terms and Conditions include the consumer terms of sale. To purchase alcohol from the company's website you must be of legal age in your country. All personal data is strictly confidential and is not shared. As an additional security precaution we do not store credit card details on our website.

Changes
We may update these Terms and Conditions from time to time for legal or regulatory reasons or to allow the company website to function properly. Any changes will be notified to the user via the email address provided by the user or through an appropriate announcement on the company's website. Changes will apply to the use of the company website after prior notice is given. If you do not want to accept the new Terms and Conditions, you should not continue to use the company's website. If you continue to use the Company Website after the date the change becomes effective, your use of the Company Website indicates your agreement to the new Terms and Conditions.

Enrollment
To register on the company's website, you must be of legal drinking age in your country. You must ensure that the information you provide upon registration or at any time is correct and complete. You must inform us immediately of any changes to the information you provided when registering by updating your personal details so that we can communicate with you effectively.

Password and security
When you register to use the company's website, you will be asked to create a password. In order to prevent fraud, you must keep this password confidential and must not disclose or share it with anyone. If you know or suspect that someone knows your password, you must notify us by contacting info@portucalefinewines.pt immediately. If Company has reason to believe that a security breach or misuse of the Company Site is likely, we may require you to change your password or we may suspend your account.

Intellectual property
The content of the Company's website is protected by copyright, trademarks, database rights and other intellectual property rights. You may retrieve and display the content of your company's website on your computer screen, save the content in electronic form to disk (but not on any server or other storage device connected to a network), or print a copy of such content for your use personal, non-commercial use, as long as you keep the copyright and any intellectual property notices intact. You may not reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Company website without the written permission of the Company.

Age restrictions
By placing an order you are confirming that you are of legal drinking age in your country. If the delivery company is in doubt about the age of the recipient of an order they will ask for some form of identification. In the event that this is not satisfied they are not authorized to leave the order.

Fraud and Crime Prevention
For the purposes of preventing or detecting offences, and/or the apprehension or prosecution of criminals, we may have to share any information we collect with the police, other public or private sector agencies or representative bodies in accordance with relevant legislation. Information shared in this way will not be used for marketing purposes.

Use of the Company Website
You may not use the Company Website for any of the following purposes:
Interfere with any other person’s use or enjoyment of the Company Website; or
make, transmit, or store electronic copies of copyrighted materials without the owner's permission.

Company Website Availability
Although we aim to offer you the best service possible, we make no promises that the services on the Company's website will meet your needs. We cannot guarantee that the services will be fault-free. If there is a failure with the company's website, you must inform info@portucalefinewines.pt and we will try to correct the failure as soon as reasonably possible. Your access to the company website may from time to time be restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will try to restore service as soon as possible.

The Company’s right to suspend or cancel your registration
We may suspend or cancel your registration immediately at reasonable discretion, or if you breach any of your obligations under these Terms and Conditions. You can cancel your registration at any time by informing us in writing at info@portucalefinewines.pt . Suspension or cancellation of your registration and your right to use the company website does not affect any rights or obligations arising from the law.

The responsibility of the Society
The Company Website may provide content from other Internet sites or resources and while the Company tries to ensure that the material included on the Company Website is correct, reputable and of high quality, it does not make any warranties with respect to such content. If the Company is informed of any inaccuracies in the material on the Site we will attempt to correct these inaccuracies as soon as possible. If we breach these Terms and Conditions, we will only be responsible for any losses you suffer as a result of this and to the extent that it is a foreseeable consequence for both of you at the time you are using the Company Website. Our liability shall in no case include business losses such as lost data, lost profits or business interruption. The Company shall have no liability for any damage or loss resulting from viruses, worms, Trojan horses or other malicious code or the corruption or loss of data or any damage to software or hardware. This clause does not limit or affect our liability arising from any products sold through the company website.

Third Party Websites
As a convenience to customers, the Company's website includes links to other sites or materials that are beyond its control.

Advertising and Sponsorship
Part of the company's website may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on their website complies with relevant laws and codes. We will not be responsible for any errors or inaccuracies in advertising and sponsorship material.

Applicable law
These Terms and Conditions will be subject to the laws of Portugal. We will try to resolve any disagreements quickly and efficiently. If you are not satisfied with the way we have dealt with your complaint, you can appeal to the Consumer Arbitration Court:

Several
You may not transfer any of your rights under these Terms and Conditions to any other person. We may transfer our rights under these Terms and Conditions to another business where we believe your rights will not be affected. If you breach these Terms and Conditions and the Company chooses to ignore this, the Company will still be entitled to utilize its rights and remedies at a later date or in any other situation where there is a breach of the Terms and Conditions. The Company will not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its reasonable control. CONDITIONS OF SALE TO THE CONSUMER
These terms relate to items supplied to you via the PortucaleFineWines website and should be read in conjunction with the General Terms and Conditions which are equally applicable.

Contract formation
These sales conditions apply to all products sold at PortucaleFineWines. There is no contract between you and the Company for the sale of any goods until the Company receives the order together with payment and the Company accepts your order. When payment has been received, the Company will confirm that your order has been accepted by sending an email to you at the email address you provided on the order form. The Company's acceptance of your order results in a legally binding contract between both parties. The Company may change these terms of sale without prior notice in relation to future sales.

Description and price of goods
The description and price of the goods you order will be shown on the company's website at the time you place your order. The prices presented on the Company's website are only applicable to sales made through the Company's website. Products are subject to availability. If at the time of receipt of your order the goods you have ordered are not available in stock, the Company will inform you as soon as possible, and reimburse you for any amount that has been paid or debited from your credit card for the acquisition of products. Every effort will be made to ensure that the prices displayed on the Company's website are accurate at the time you place your order. If an error is found, the Company will inform you by email to the address provided on your order form as soon as possible and offer you the option of confirming your order at the correct price or canceling your order. In case of cancellation of the order, the Company will refund any amount that has been paid or debited. In addition to the price of the product, you may be required to pay a delivery fee for the merchandise, as shown during the payment process on the Company's website. If you do not agree with the delivery price indicated during check-out, then you should not proceed with the order. The price of products and delivery fees are inclusive of VAT where indicated. You will only be asked to enter your credit/debit card details after confirming the order on our payment partners' website. We do not have access to the payment information you enter on our payment partner website. All credit and debit card holders are subject to validation and authorization checks by the card issuer. If your payment card issuer refuses to authorize payment, the Company will not be responsible for any delay or non-delivery of the order. Additionally, in the interest of preventing fraudulent use of credit and debit cards, the Company may validate names and addresses provided during the order process against commercially available records. We may need to contact you by phone or email to check details before sending your order.

Harvest Years
We will send you a most recent harvest year whenever the advertised harvest year is not available. Please indicate in the order notes during check-out if you do not wish to change the harvest year. If you are unable to include this in the order notes, we will always accept the return of the product, when agreed between both parties, however, shipping costs are not subject to return, which are the responsibility of the person returning the products.

Payment
Payment for products and delivery fees can be made using: - PayPal Account - Credit or debit cards from Maestro, Visa, Mastercard, América Expresso brands charged by the company Baintree - Bank Transfer - Multibanco - MBWay. In all cases the Company does not have access to or record any information from your debit/credit card or bank account.

Delivery
When placing an order you will be informed of the cost of delivery to your address/country during the checkout process and this includes transport and delivery of your order.
Orders to be delivered to any EU country include local VAT tax and our company is subject to paying VAT in each EU country where we sell.
Furthermore, all the products we sell are already legal for the consumer market with taxes paid, which means that we are authorized to sell our products to any country within the EU.
There may be some exceptions where the law of the country requires the payment of a local tax on wines or spirits. In these cases, the amount may be requested at the time of delivery of the goods, so check with your local authorities whether you are entitled to import wines from another EU member state and what fees may be charged.
Prices for customers outside the EU do not include local VAT or any other local taxes.
Import procedures are managed by our transport partner, which means that upon arrival of your order, they will present it to local customs and contact you with the amounts to be paid for importing the merchandise and how to proceed with payment. .
In most countries, taxes will depend on the value of the order and excise taxes on the type and number of products in the order. We cannot guarantee that you are not eligible to pay duties and taxes in your country, so please contact your local customs office to verify this and find out the amounts involved before placing your order.
If you can't find your country in the Country selection box during the checkout process, it's because we don't deliver to your country. You can contact us by email and we can offer you an alternative delivery option if we have any way of guaranteeing the successful delivery of your order. For corporate orders use our contact form or email to place your order and we will provide you with our best price for the order and the lowest possible shipping costs.
The products you order will be delivered to the address you provide when placing your order. When placing your order you can contact us with instructions for delivery alternatives in case you are not at the address on the scheduled delivery day.
All installments must be signed for upon delivery by a person of legal drinking age. If there is no one at the address eligible to receive the merchandise, the recipient will be notified of an alternative day for delivery or will be asked to contact the transport company to arrange a new delivery. If after several failed delivery attempts to the address provided and an eligible recipient is not present to sign for receipt of the package, or if no effort is made by the recipient to contact the shipping company to reschedule a new delivery, the package will be returned to our warehouse. In this case, a delivery surcharge may be paid by the customer, so that the goods can be resent. The Company will contact you to schedule this new delivery.
Every effort will be made to deliver goods within 3 to 5 working days, however in rare cases delivery time may be up to 10 working days. The Company will not be responsible for any loss or damage suffered by you arising from any delay in delivery.
After delivery, you become the owner of the goods you ordered and are responsible for any risk of loss or damage to the products you receive.


Ruptures and failures
If there are breaks in your order, we will refund the cost of the damaged bottles by creating a voucher, refunding the amount to your credit card, your paypal account, your bank account or we will send replacement bottles. We will always return any product that you receive damaged. Each box must be carefully checked upon delivery to make sure it is intact and the order is complete. Requests for breakages will only be accepted if we are notified within 24 hours of delivery and the damaged products and their packaging are kept in case a check is required. The carrier must be informed of the breakages at the time of delivery. We do not accept any requests for breakages or missing products unless they are recorded in the carrier's documentation.

Returns
The Company accepts to exchange any products purchased that are contaminated or spoiled. We demand the bottle and cork returned to us before we can exchange. Returns are subject to a shipping fee, which is the responsibility of the person sending back the wines.

Your right to withdraw
You have the right to cancel the contract at any time up to 14 days after receiving the goods. To exercise the right of withdrawal, you must notify the Company in writing by email to info@portucalefinewines.pt and include your order ID and the products to be returned. If you choose to exercise your right to cancel after the products have been delivered, unless the products are defective or have been delivered in error, you must contact the Company via email at info@portucalefinewines.pt to arrange collection at carrier, with the delivery cost being borne by you. You must take appropriate steps to ensure that products are not damaged during return transport. Once you have notified the Company that you wish to cancel the contract, the Company will refund or credit within 30 days from the date of cancellation any amount that has been paid by you or charged to your credit card in respect of the returned products. If you do not make the products available for collection to our carrier, the Company may charge the amount relating to the direct costs inherent in collecting the products.

Data protection
The Company will take all reasonable precautions to keep your order and payment details secure, but unless the Company is negligent, the Company will not be responsible for unauthorized access to information provided by you. The Company will use the information provided about you only to correctly fulfill your order. The Company will inform you about products and offers that may be of interest to you from time to time and through its newsletter. If you do not wish to be informed of these offers, please send an email to info@portucalefinewines.pt indicating in the email your request to unsubscribe from our newsletter. You can correct or delete any information about you by logging into your customer account in the "My Account" area or by contacting us by email at info@portucalefinewines.pt .

Applicable law
These conditions of sale and supply of products are subject to Portuguese law, and Portuguese courts will have jurisdiction in relation to any dispute arising from the sales contract.
